Orders

Orders are accepted subject to the conditions and terms listed herein, the availability of product, and prices in effect at the time of shipment. Items not shipped will be backordered or direct shipped and will be invoiced at the time of shipment. Irrigation-Mart is not responsible for any loss or delay in shipping due to conditions beyond its control. Irrigation-Mart reserves the right to require pre-payment for any order.

Prices

All prices are FOB Irrigation-Mart warehouse or other shipping location. Prices do not include shipping, special packaging, insurance, taxes, duties, and other similar charges, except as expressly provided by Irrigation-Mart by written notice on quotes, order confirmations, or invoices. Prices are subject to change without notice. Irrigation-Mart reserves the right to correct clerical errors in quotes, orders, invoices or any other documents.

Terms of Payment

All sales are made on a Cash Basis unless a charge account has been established. Methods of payment accepted are Credit Cards (Visa, MasterCard, American Express, Discover), Check, ACH, Money Order, Wire Transfer, and Cash. Payments made by credit card will be charged a processing fee. Terms of payment on charge accounts will be due based upon net days from invoice date. Past due accounts are subject to a late fee charge of 18% (eighteen percent) per annum. There will be a $25 (twenty-five dollar) fee charged for all returned checks/insufficient funds. Accounts over 60 days past due are subject to termination or being placed on a cash basis. Inactive accounts will be closed. In the case of a change of company name or ownership, a new credit application must be completed and processed before future purchases may be made on credit.

Security Interest

In consideration for the sale of products to Buyer, Buyer grants to Irrigation-Mart a security interest in the products, and to all proceeds therefrom; including, without limitation, accounts, general intangible and chattel paper, to secure payments to Irrigation-Mart of all monies now or hereafter owed by Buyer to Irrigation-Mart in connection with sale of the products to Buyer. Irrigation-Mart may file a UCC lien to secure this interest. Buyer agrees to execute and deliver any documents Irrigation-Mart may require in order to enable Irrigation-Mart to perfect its security interest.

Special Order

Special order items are not returnable. Special orders may include, but are not limited to, cut lengths of hose, fabricated fittings, assembled components, or non-stock items. Special orders may be required to be prepaid.

Sales Tax

All items will be taxed at the applicable tax rate and jurisdiction required by law unless a resale or exemption certificate is completed and on file with Irrigation-Mart.

Shipping

Orders will be shipped via UPS, Fed Ex, USPS, or common carrier. Buyer will be responsible for all shipping costs unless expressly otherwise agreed upon in writing by Irrigation-Mart.

Carrier Claims

Buyer accepts all risk of loss for damage of shipments by the carrier. All claims for shortages or damages must be reported to the carrier and a claim filed with the carrier by the Buyer within two (2) days of receipt of the shipment. If such a claim is not filed within two (2) days after delivery to Buyer, then Buyer agrees to indemnify and defend Irrigation-Mart from any claims related to such damage.

Manufacturer Claims

All claims for defective material, shortages, and/or discrepancies must be reported in writing within 10 (ten) days of receipt of merchandise. All claims for defective material are subject to the terms of the warranty provided by the manufacturer. Irrigation-Mart makes no claims to warranty other than those provided by the manufacturer.

Returns

No merchandise may be returned without prior authorization and issuance of a return authorization number from Irrigation-Mart. Credit will be based on invoice price. A restocking fee of 20% (twenty percent) will be assessed on all returned goods unless return occurred due to Irrigation-Mart’s error. Returned goods shall be shipped prepaid by Buyer and received in resalable, new condition before credit will be issued. All returns are subject to inspection by Irrigation-Mart. Buyer will be billed for any freight charges incurred by Irrigation-Mart unless pre-approved by Irrigation-Mart and/or returned due to an Irrigation-Mart error. No returns accepted after 60 days.

Liability

Buyer asserts that it has all skill, knowledge, and training in terms of product usage. Irrigation-Mart shall not be liable for any loss, injury, damage, direct or consequential, arising out of the use or inability to use the product. Before using, user shall determine the suitability of the product for the intended use, and user assumes all risk and liability whatsoever in connection therewith. The forgoing may be changed only by written agreement by Irrigation-Mart.

Warranty

All products are subject to the warranty conditions set forth by the manufacturer. Neither Irrigation-Mart nor its employees provide any warranty, expressed or implied, other than those imposed by law.

Governing Law

These Terms and Conditions shall be governed by the laws of the State of Louisiana.

Irrigation-Mart's Customer's/Irrigator's Bill of Rights

Please discuss the following items with your irrigation designer/dealer/provider Existing and emerging technologies make it possible to design irrigation systems that increase crop production while conserving natural resources and enhancing environmental quality.

Provider's Qualifications

  • Reputation, references, and credentials including formal training, certifications, and registrations; e.g., professional engineer license, etc.
  • Design Features (General)
  • Life expectancy
  • Safety features
  • Upgrade options
  • Recommended list of spare parts

Specific Operating/Design Parameters

  • Distribution Uniformity of flow throughout the whole field when brand new
  • Anticipated Irrigation Efficiency (IE)
  • Water requirements
    • Peak need (at least 6 gpm/ac 24/7, 0.3 in/day, 8000 gal/ac/day)
    • Pumping/delivery rate (acre-inches/day, gal/min)
    • Frequency or irrigation during peak water use period (daily)
    • Maximum application (length of time) per irrigation event (min)
    • Anticipated amount of water to be used per year (acre-feet, gal)
  • Energy consumption – controlled by System/Irrigation Efficiency (IE) and System Pressure (TDH)
    • Is it possible to pump during off peak hours
    • What are the pump, motor, and pumping efficiencies
    • Are you provided with a pump curve, showing the gpm vs. pressure
    • What is the sensitivity of pump flow rate to changes in the elevation of the water source
    • What is the energy cost per acre-foot or gallon
  • Filtration
    • Is filtration necessary, and if so, what type is provided
    • What is the required mesh or micron size
    • Is the mesh size no more than 1/10 of the diameter of the smallest passage-way of the emitting device
    • How frequently will filter flushing be necessary, and how much water will be used per (back) flush
    • What is the procedure for flushing (manual, automatic, take apart)
    • How will the flush water be disposed of
    • Does the pump provide enough water to operate both the filter backflush and the irrigation system simultaneously
    • What are the initial adjustments for the filter, and who will do them
    • If there is a backflush adjustment, is it possible to view and sample the backflush water in order to make proper filter adjustments
    • What are the design safety factors (pressure) of the filters
  • Filtration
    • Are adequate and approved backflow prevention and safety devices provided
    • What is the injection rate (gph, ppm)
    • Can the equipment inject both fertilizers and other chemicals?
  • Flow Meter
    • Does it measure both flow rate (gpm) and volume (acre-feet, gal)
    • Does installation follow manufacturer’s recommendations with regard to lengths of straight pipe, pipe diameter, and straightening vanes?
  • Pressure, air and flushing
    • Are there adequate continuous air vents, vacuum relief valves, and flushouts?
    • What are the number, type, and size of pressure regulating and relief valves?
    • Is the pressure rating of pipe sufficiently high for the anticipated water temperature, surge pressures, and normal pressures

Generalities and Warranties

  • Who provides installation, start-up, and adjustment
  • What is the availability of replacement parts and the projection of the longest possible down time due to unavailability of parts
  • What are the warranties on individual component and “system” design performance
  • Who is providing warranties and what do the warranties cover and exclude
  • Are the providers financially capable of standing behind their warranties
  • Will you be provided with a binder containing as-installed plans/sketches, manufacturers’ literature, warranties, and operation instruction for the system
